Canada’s latest low-wage Labour Market Impact Assessment (LMIA) update matters to employers planning overseas recruitment and workers assessing Canadian job offers. Before committing to a hiring timeline, both parties should check the actual work location, offered wage and applicable program requirements.
The updated rates apply from October 9, 2026, through January 7, 2027; the next update is January 8, 2027. ESDC’s official unemployment-rate table provides the applicable figures.
The underlying restriction dates from September 26, 2024. Certain applications are not processed when the offered wage falls below the provincial or territorial threshold and the job is in a census metropolitan area (CMA) with unemployment of at least 6%. October 9 is a rate-table update, rather than the introduction of this rule.
The following CMAs meet the 6% threshold for this period. Sector and position exemptions may apply.
Exemptions cover primary agriculture, construction (NAICS 23), food manufacturing (311), hospitals (622), nursing/residential care (623), specified private-household caregivers (NOC 31301, 32101, 44100, 44101), and permanent-residence-only positions without a work-permit application.
Truly temporary or highly mobile positions, generally lasting 120 days or less, can qualify through a written exemption request; longer durations receive exceptional consideration.
Quebec caregiver exemptions require qualifying medical circumstances and a physician’s note. Employers must also review the separate Montréal/Laval measure, which runs through December 31, 2026. Consult ESDC’s Quebec guidance; exemptions under different measures should not be treated as interchangeable.
Use the complete workplace postal code to identify its census geography, rather than relying on a city name or mailing address. Then match the CMA to the table for the submission period. Being outside the restricted geography does not establish that the entire application meets program requirements.
Compare the offered wage with the current provincial or territorial hourly threshold. Low-wage classification is based on this comparison, not simply the job title. A higher wage must reflect comparable Canadian employment and the prevailing wage; increasing it merely to avoid a requirement can lead to a negative decision.
Under the low-wage program requirements, employers must check the applicable workforce cap, generally 10%, with 20% for designated sectors and caregivers. Other exemptions or temporary measures require separate assessment. A CMA exemption does not automatically remove the cap.
Recruitment generally requires Job Bank advertising, youth outreach and two additional methods targeting different underrepresented groups. Advertisements must run for at least eight consecutive weeks within the three months before submission, with at least one activity continuing until the LMIA decision, subject to applicable variations. Employers must retain recruitment records for six years and offer full-time work of at least 30 hours weekly.
For employers, the practical priority is to resolve processing eligibility before building recruitment plans around an overseas hire. Keep a dated record of the wage comparison, worksite geography and any claimed exemption, alongside advertising evidence.
For workers, ask the prospective employer which stream and worksite underpin the offer. Do not make travel or resignation decisions solely on an assurance that an LMIA will be available. A credible recruitment plan should explain its eligibility basis and remaining steps without promising an outcome.
