A judge has ruled that spouses of H-1B visa holders are permitted to work in the nation, which is a significant victory for foreign employees in the US technology sector. In the process, US District Judge Tanya Chutkan dismissed a lawsuit filed by Save Jobs USA, which had urged the court to invalidate an Obama-era rule that gave spouses of certain types of H-1B visa holders the ability to work.
Several tech giants, including Amazon, Apple, Google, and Microsoft, opposed the lawsuit. Nearly a million H-1B spouses have received work authorizations from the US so far, with a disproportionately high number of Indians receiving these authorizations.
Save Jobs USA’s primary argument in the court’s ruling is that Congress never authorized the Department of Homeland Security to permit foreigners on H-4 visas to work.
However, she said, this assertion directly conflicts with the language of the Immigration and Nationality Act, decades of executive branch practice, and both explicit and tacit congressional approval of that practice.
According to the judge’s ruling, Congress has explicitly and deliberately given the US Government the authority to approve employment as a legal prerequisite for an H-4 spouse’s admission to the country.
She asserts that the federal government’s longstanding and open practice of authorizing employment for comparable visa classes is another proof that Congress has given its consent for the federal government to use that jurisdiction.
In accordance with Judge Chutkan’s ruling, the Department of Homeland Security and its predecessors also authorized employment for spouses and dependents of students. The judge dismissed the complaint brought by Save Jobs USA, writing that the Department of Homeland Security has long granted work permits to spouses of foreign government officials and spouses of workers or officers of international organizations.
Until recently, spouses of H1B visa holders could not work, placing a heavy financial burden on families. Allowing H1B spouses to work is not only in the best interests of economic justice but also of family stability and cohesion.
